between san jos skbrai its city worker autos a state agency charged a city failed to bargain over pension reforms. david louie joins us now with that part of the story. david? >> employees campaigned hard to defeat pension reform on last year's ballot, they lost but are getting a seconds chance. the relations board filed a complaint against the city of san jose that it didn't negotiate adequately before pugt its plan up for a public vote. >> the city had a requirement to bargain in good faith. they did not do so. if they make that finding then measure b will be eliminated. >> the state agency will try to get the two sides to reach a settlement f that fails a dispute goes from a judge. the mayor disagree wtz assessment as the city didn't put effort into negotiations with it's 11 employee bargaining units. >> we've negotiated almost endlessly for months trying to get a resolution.

we worked hard and unfortunately with the bargaining we were not able to get to an agreement on the terms. >> the city pension reform plan was approved by a 70% margin, creating a new lower benefit plan for new hires and boosted employee contributions. >> it could make tos -- months, possibly until the end of the year before there is a resolution. it will depend on how soon the judge can hear this case. >> sports news, 49ers announced their trade of quarterback alex smith to kansas city chiefs nearly two weeks after the two side as agreed to it. the teams couldn't anounts deal until today. now, alex still has to pass a physical for the trade to be complete but that is more of a formality. niners will receive the second round draft pick this year. >> you know sun slow to come out but it's glorious now. >> it's getting warmer and

we want to bring you breaking news we brought you at the top of the newscast. sky 7 is over the scene of a gas line on fire. you can see emergency crews are securing and cleaning up that fire now. >> the location here is on martin luther king junior way in north berkeley. what have you been able to learn about this situation? >> this fire went on about an hour and a half. if you look from sky 7 live right now, you can see that

they're just wrapping it up. you can see firefighters down there wrapping it up earlier, they're hosing down firefighters because they're covered in foam trying to stop that gas fire from shooting out and burning the house next to it. if you look at the video you may be able to see flames shooting from behind from a receivered gas line behind that white truck. around 2:30 the homeowner says a crew was replacing a sewer line. they struck a gas line and ignited a fire that firefighters were unable to put out. fire was coming from the ground as pg&e tried to shut it off. they were unable to as at that shuttoff valve. another crew arrived and it looked like they're able to shut it off from the gas main but not brit burned up the house and truck in the driveway. there were no injuries with you a scary moment for this

an oakland man exonerated after spending 14 times in prison for a crime he never committed says he's not angry. johnny williams spoke to vic lee. vic? >> johnny williams is now 38 years old. he considers this a new window in his life. he wants to go to school, he wants to find a skrob, wants to spend more time with his family. we spoke to him today here at

the offices of the innocence project. >> i feel blessed. >> johnny williams kept his hope as live n 1998, williams was arrested for sexual assaulting a 9-year-old girl when she was walking to school in east oakland. the girl told her mother she heard her attacker say his name was johnny. >> the family knew johnny from the neighborhood. they heard the name, they jumped to a conclusion that it was johnny williams. >> during trial the girl testified williams was the attacker. he was sent to prison in san diego. the 14 years there, he said was a living hell. his spirit dmot be defeated. >> i read my books. >> reality was innocence. one day, learned about the

innocence project. >> i say i'm going to take this chance. >> this was the letter in 2006 that touched a staff at the innocence project. he says he was innocent, please help, i'm not lying. lawyers for the project received auj saigs to test the girl's clothing for evidence. and found sperm on the tee shirt did not match williams dna. friday, fruiters concluded that williams, who had been paroled was in the guilty. >> i've never been mad about this, i knew if i stayed true, to my belief in god, the truth should come out. >> he says he is not angry at the young girl. he just wants police to find the real attacker.

>> vic, thank you. >> the man accused of killing a dozen people in a movie theater in colorado last year did not enter a plea in court so the judge did it for him. his defense team said they were not ready to enter a plea. the judge refused for more time entered a not guilty plea for holmes and said they can change it at a later date. holmes faces 166 charges for killing 12 people, injuring dozens of others during a midnight showing of dark knight rises eight months ago. >> i'm assuming they'll change the plea but biggest thing, i think is that just something was significant about today at least something got done. >> prosecutors will announce in april whether they plan to ask for the death penalty for holmes. his trial is set to begin in august. >> this is just horrific. a 6-month-old baby girl became
